Please read these Terms and Conditions carefully before using our Service. By accessing or using the Edukko platform, you agree to be bound by these Terms.

  1. INTERPRETATION AND DEFINITIONS

1.1 Interpretation

Words with capitalised initial letters have the meanings defined below. These definitions apply whether they appear in singular or plural form.

1.2 Definitions

“Company” (also referred to as “Edukko”, “we”, “us”, or “our”) refers to Edukko Learn FZE, registered at DTEC, Dubai Silicon Oasis, Dubai, United Arab Emirates.

“Country” refers to the United Arab Emirates.

“Device” means any device that can access the Service, such as a computer, mobile phone, or tablet.

“Edukkator” means an independent educator who has been vetted and approved by Edukko to provide tutoring services through the Platform.

“Lesson” or “Session” means a scheduled tutoring session between a Student and an Edukkator, delivered online or in person through the Platform.

“Parent” means the parent or legal guardian of a Student who is under the age of 18.

“Platform” refers to the Edukko website (edukko.ae), web application, and any associated mobile applications.

“Service” refers to the tutoring marketplace, online classroom, scheduling, payment processing, and all related services provided through the Platform.

“Student” means any individual receiving tutoring or educational services through the Platform.

“User” or “You” means any individual or legal entity accessing or using the Service, including Students, Parents, and Edukkators.

  1. ACKNOWLEDGEMENT AND ACCEPTANCE

2.1 These Terms govern your access to and use of the Service and constitute a binding agreement between you and the Company.

2.2 By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2.3 If you are under the age of 18, you may only use the Service with the consent and supervision of a Parent or legal guardian. The Parent or guardian agrees to be bound by these Terms on the minor’s behalf and accepts full responsibility for the minor’s use of the Service.

2.4 If you disagree with any part of these Terms, you must not access or use the Service.

  1. TUTORING SERVICES AND LESSON POLICIES

3.1 Nature of Service

Edukko operates as a platform that connects Students and Parents with independent Edukkators. Edukko facilitates the matching, scheduling, and delivery of tutoring sessions but does not itself provide tutoring instruction. Edukkators are independent contractors and are not employees of Edukko.

3.2 Booking and Scheduling

(a) Lessons are booked through the Platform based on Edukkator availability and the Student’s requirements.

(b) Once a booking is confirmed, both the Student (or Parent) and the Edukkator receive confirmation with the session details, including date, time, subject, and access link (for online sessions).

(c) All session times are displayed in the timezone set in your account profile. It is your responsibility to ensure your timezone settings are correct.

3.3 Cancellations and Rescheduling

(a) Cancellations or rescheduling requests must be made at least 24 hours before the scheduled session start time.

(b) Cancellations made with 24 hours or more notice: the session credit will be returned or the session may be rescheduled at no additional cost.

(c) Cancellations made with less than 24 hours notice: the full session fee may be charged, at the Company’s discretion.

(d) Edukko reserves the right to cancel or reschedule a session due to Edukkator unavailability, technical issues, or other circumstances beyond reasonable control. In such cases, the Student will be offered a rescheduled session or a full credit.

3.4 No-Shows

(a) Student no-show: If a Student fails to attend a confirmed session without prior notice, the full session fee will be charged. No refund or credit will be issued.

(b) Edukkator no-show: If an Edukkator fails to attend a confirmed session, the Student will receive a full credit or refund, and Edukko will work to arrange a replacement session.

3.5 Lesson Conduct

(a) Students and Parents agree to be respectful and courteous to Edukkators at all times.

(b) Edukko reserves the right to suspend or terminate the account of any User who engages in abusive, disruptive, or inappropriate behaviour during sessions.

(c) For online sessions, Students are responsible for ensuring they have a stable internet connection and a suitable learning environment.

  1. PAYMENT TERMS AND REFUND POLICY

4.1 Fees

(a) Tutoring fees vary by subject, curriculum, Edukkator qualification, and session format (online or in-person). Current pricing is available on the Platform or upon request.

(b) All fees are quoted and payable in United Arab Emirates Dirhams (AED) unless otherwise stated.

(c) Edukko reserves the right to adjust pricing at any time. Any changes will not affect sessions already booked and confirmed at the time of the price change.

4.2 Payment

(a) Payment is required at the time of booking or in accordance with the payment schedule agreed for your chosen package.

(b) Payments are processed securely through the Platform’s integrated payment system. Edukko does not store your full payment card details.

(c) All payments must be made through the Platform. Direct payments to Edukkators outside the Platform are strictly prohibited and may result in account suspension.

4.3 Refunds

(a) Refund eligibility is determined by the cancellation policy outlined in Section 3.3.

(b) If you are dissatisfied with the quality of a lesson, you must notify Edukko within 48 hours of the session. Edukko will review your concern and may, at its discretion, offer a replacement session, credit, or partial refund.

(c) Refunds for lesson packages are calculated on a pro-rata basis for unused sessions only, less any applicable administrative fees.

(d) Refunds, where approved, will be processed within 14 business days using the original payment method.

(e) Edukko is not obligated to provide a refund for any session that was fully delivered, except as required by applicable UAE consumer protection law.

  1. EDUKKATOR CONDUCT AND QUALITY STANDARDS

5.1 Vetting and Qualifications

(a) All Edukkators undergo a screening and interview process before being approved to use the Platform. This includes verification of academic qualifications, teaching experience, and professional references.

(b) While Edukko takes reasonable steps to verify Edukkator credentials, we do not guarantee the accuracy of all information provided by Edukkators and are not liable for any misrepresentation by an Edukkator.

5.2 Professional Standards

Edukkators are expected to:

(a) Deliver sessions that are well-prepared, curriculum-aligned, and appropriate for the Student’s level.

(b) Communicate respectfully and professionally with Students, Parents, and Edukko staff at all times.

(c) Arrive on time for all scheduled sessions and notify Edukko promptly if they are unable to attend.

(d) Maintain the confidentiality of all Student information and learning records.

5.3 Quality Assurance

(a) Edukko regularly monitors the quality of tutoring through session feedback, Parent and Student reviews, and internal assessments.

(b) Edukkators who consistently fail to meet Edukko’s quality standards may be removed from the Platform.

(c) If you have concerns about an Edukkator’s conduct or teaching quality, please contact us at [email protected]. We will investigate all complaints promptly and take appropriate action.

  1. DATA PRIVACY AND CHILD SAFEGUARDING

6.1 Data Collection and Privacy

(a) Edukko collects and processes personal data in accordance with our Privacy Policy and applicable UAE data protection laws, including Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data.

(b) By using the Service, you consent to the collection, processing, and storage of personal information as described in our Privacy Policy.

(c) Personal data collected may include: name, email address, phone number, date of birth, academic records, payment information, session recordings (where applicable), and usage data.

(d) We do not sell personal data to third parties. Data may be shared with Edukkators solely for the purpose of delivering tutoring services.

6.2 Children’s Data

(a) Edukko recognises the importance of protecting the privacy and safety of minors. Where a Student is under 18, we require verifiable parental consent before collecting or processing the child’s personal data.

(b) Parents and legal guardians have the right to review, correct, or request deletion of their child’s personal data by contacting us at [email protected].

(c) We limit the collection of children’s data to what is reasonably necessary to provide the tutoring service.

6.3 Safeguarding

(a) Edukko is committed to the safety and wellbeing of all Students, particularly minors. All Edukkators are expected to adhere to Edukko’s Safeguarding Policy.

(b) Edukkators must not engage in any behaviour that could be considered inappropriate, harmful, or exploitative toward a Student.

(c) Any User who becomes aware of safeguarding concerns must report them immediately to Edukko at [email protected]. Edukko will investigate all reports and may involve relevant authorities where necessary.

(d) For online sessions involving minors, we recommend that a Parent or responsible adult is present in the room or nearby, particularly for younger students.

6.4 Session Data and Recordings

(a) Edukko may record online sessions for quality assurance and safeguarding purposes. Where recordings are made, Users will be informed in advance.

(b) Session recordings are stored securely and are not shared with third parties except where required by law or for safeguarding purposes.

  1. USER ACCOUNTS AND RESPONSIBILITIES

7.1 You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

7.2 You agree to provide accurate, current, and complete information when creating your account and to update your information as necessary.

7.3 You must notify Edukko immediately if you become aware of any unauthorised use of your account.

7.4 Edukko reserves the right to suspend or terminate any account that violates these Terms or is used for fraudulent or unlawful purposes.

  1. INTELLECTUAL PROPERTY

8.1 All content, materials, branding, software, and technology on the Platform are owned by or licensed to Edukko and are protected by applicable intellectual property laws.

8.2 Teaching materials created and shared by Edukkators during sessions remain the intellectual property of the respective Edukkator unless otherwise agreed in writing.

8.3 You may not copy, reproduce, distribute, or create derivative works from any content on the Platform without prior written consent from Edukko.

  1. LIMITATION OF LIABILITY

9.1 Edukko acts as a marketplace connecting Students with Edukkators. To the maximum extent permitted by law, Edukko shall not be held liable for the quality, accuracy, or outcome of any tutoring session delivered by an Edukkator.

9.2 Edukko’s total liability to you for any claim arising from or related to the Service shall not exceed the total amount you have paid to Edukko in the 12 months preceding the event giving rise to the claim.

9.3 To the maximum extent permitted by applicable law, Edukko shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of academic results, loss of data, or business interruption.

9.4 Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable UAE law.

  1. “AS IS” DISCLAIMER

10.1 The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied.

10.2 Edukko does not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

10.3 Edukko makes no guarantees regarding academic outcomes, examination results, or the suitability of any particular Edukkator for your needs.

  1. LINKS TO THIRD-PARTY SERVICES

11.1 The Platform may contain links to third-party websites or services not owned or controlled by Edukko.

11.2 Edukko assumes no responsibility for the content, privacy policies, or practices of any third-party services.

  1. TERMINATION

12.1 We may terminate or suspend your access to the Service immediately, without prior notice, if you breach these Terms.

12.2 You may terminate your account at any time by contacting us at [email protected].

12.3 Upon termination, your right to use the Service will cease immediately. Any outstanding payment obligations and any provisions of these Terms that by their nature should survive termination shall remain in effect.

  1. GOVERNING LAW AND DISPUTES

13.1 These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates.

13.2 Any dispute arising from or in connection with these Terms shall first be resolved through good-faith negotiation by contacting the Company at [email protected].

13.3 If a dispute cannot be resolved informally within 30 days, either party may submit the matter to the competent courts of Dubai, United Arab Emirates.

  1. SEVERABILITY AND WAIVER

14.1 If any provision of these Terms is held to be unenforceable or invalid, it shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

14.2 The failure to exercise a right under these Terms shall not constitute a waiver of that right.

  1. TRANSLATION INTERPRETATION

15.1 These Terms and Conditions may be made available in languages other than English. In the event of a dispute, the original English text shall prevail.

  1. CHANGES TO THESE TERMS

16.1 Edukko reserves the right to modify these Terms at any time. Material changes will be communicated with at least 30 days’ notice via email or a prominent notice on the Platform.

16.2 Your continued use of the Service after such changes constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.
